1. Acceptance of Terms

By accessing or using CantaHub ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These terms apply to all users, including visitors, registered users, and paying subscribers.

2. Description of Service

CantaHub is a marketing automation platform providing CRM, AI copywriting, email sequences, landing page builder, community monitoring, and related tools. Features vary by subscription plan. We reserve the right to modify or discontinue features at any time with reasonable notice.

3. Accounts & Eligibility

• You must be at least 18 years old to use the Service
• You are responsible for maintaining the security of your account credentials
• You may not share your account or use it for multiple unrelated businesses without upgrading to an Agency plan
• You must provide accurate account information and keep it up to date

4. Subscription & Payment

Paid subscriptions are billed in advance on a monthly or annual basis via Stripe. All prices are in USD. By subscribing, you authorize us to charge your payment method automatically at each renewal period. You may cancel at any time; cancellation takes effect at the end of the current billing period. No refunds are provided for partial periods except where required by law.

5. Acceptable Use

You agree not to use the Service to:

• Send unsolicited bulk email (spam) or violate CAN-SPAM, GDPR, or CASL
• Harass, threaten, or abuse any person
• Distribute malware, phishing content, or fraudulent material
• Scrape or harvest data from the Service beyond normal use
• Resell or sublicense the Service without written permission (except Agency white-label plan)
• Violate any applicable local, national, or international law

We reserve the right to terminate accounts that violate these terms without refund.

6. Your Data & Intellectual Property

You retain full ownership of your data (contacts, content, campaigns). By using the Service, you grant us a limited license to process your data solely to provide the Service. We will never sell your data to third parties. AI-generated content produced using our tools is yours to use commercially without restriction.

7. Limitation of Liability

To the maximum extent permitted by law, CantaHub shall not be liable for any indirect, incidental, special, or consequential damages, including lost profits, arising from your use of or inability to use the Service. Our total liability to you shall not exceed the amount you paid us in the 12 months preceding the claim.

8. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind. We do not warrant that the Service will be uninterrupted, error-free, or that defects will be corrected. Email deliverability, open rates, and conversion results are not guaranteed.

9. Termination

We may suspend or terminate your account immediately for violations of these Terms, non-payment, or conduct we determine to be harmful to other users or the platform. You may terminate your account at any time via the Settings page. Upon termination, your data will be retained for 30 days before deletion.

10. Changes to Terms

We may revise these Terms at any time. We will notify you of material changes by email at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.

11. Governing Law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Delaware.
